These Terms of Service ("Terms") govern your access to and use of the DialDay mobile application ("the Application", "we", "us", or "our"), operated by Petros Chatzianastasiou ("Service Provider"), based in Greece (European Union).
By downloading, installing, accessing, or using DialDay, you agree to be bound by these Terms. If you do not agree, do not use the Application.
1. Acceptance of Terms
By creating an account or using the Application, you confirm that:
- You are at least 16 years of age (or the legal minimum age in your jurisdiction)
- You have the legal capacity to enter into a binding agreement
- You agree to comply with these Terms and our Privacy Policy
- The information you provide is accurate and you will keep it up to date
If you are using the Application on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
DialDay is a customer relationship management application designed for direct sales representatives, real estate agents, insurance brokers, B2B sellers, and other professionals who sell on the phone. The Application provides:
- Contact management with phone book synchronization
- Call logging and activity tracking
- Cadence-based follow-up scheduling
- Daily call goal tracking
- Lead pipeline management
- Pro features for users on a paid subscription
The Application is provided as a Freemium service with a free tier and an optional Pro subscription.
3. User Accounts
3.1 Registration
To use the Application's core features, you must create an account using a valid email address. You are responsible for:
- Providing accurate, current, and complete information
- Maintaining the security of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
You may not share your account credentials with third parties or transfer your account to another person.
3.2 Account Termination
You may delete your account at any time by contacting support@dialday.app or using the in-app account deletion feature when available.
We reserve the right to suspend or terminate accounts that violate these Terms, including but not limited to: fraud, abuse, illegal activity, or violations of third-party rights.
4. Subscription and Payments
4.1 Free Tier
The Application offers a free tier that includes the first 100 contacts at no cost, with no time limit and no credit card required. Free tier features may change over time at our discretion.
4.2 Pro Subscription
The Pro subscription unlocks unlimited contacts and additional features. Pricing:
- Monthly: €9.99 per month
- Annual: €79.99 per year (approximately 33% savings vs monthly)
Prices may vary slightly based on local currency, taxes, and Apple App Store or Google Play pricing tiers in your region.
4.3 Payment Processing
All payments are processed by Apple App Store (for iOS) or Google Play (for Android). We do not see, store, or process your payment card details. Payment-related disputes must be addressed through Apple or Google's standard support channels.
4.4 Auto-Renewal
Pro subscriptions are auto-renewing. Your subscription will automatically renew at the end of each billing period (monthly or annual) unless canceled at least 24 hours before the renewal date. You can manage and cancel your subscription through your Apple App Store or Google Play account settings.
4.5 Refunds
Refund requests are handled entirely by Apple App Store or Google Play according to their respective refund policies. We are unable to issue refunds directly. To request a refund:
- iOS users: Use Apple's "Report a Problem" feature at https://reportaproblem.apple.com
- Android users: Use Google Play's refund process at https://play.google.com/store/account
For purchases within EU consumer law refund windows, you retain all statutory rights regardless of these Terms.
5. Acceptable Use
You agree NOT to use the Application to:
- Violate any law, regulation, or third-party right
- Send spam, unsolicited messages, or fraudulent communications
- Store contact data without the consent of the contact owner
- Engage in deceptive marketing, pyramid schemes, or other unlawful business structures
- Attempt to gain unauthorized access to the Application, other user accounts, or our infrastructure
- Reverse-engineer, decompile, or attempt to extract the source code
- Use the Application for any purpose that infringes intellectual property rights
- Resell, sublicense, or redistribute the Application
- Use automated tools (bots, scrapers) to interact with the Application without permission
- Upload malicious code, viruses, or harmful content
- Impersonate another person or misrepresent your affiliation
You are solely responsible for ensuring your use of the Application complies with applicable laws, including consumer protection laws, data protection laws (e.g., GDPR), and laws governing direct sales in your jurisdiction.
6. Your Data and Content
6.1 Ownership
You retain all ownership rights to the data you create or upload through the Application, including your contacts, call logs, notes, and other CRM data.
6.2 License to Us
By using the Application, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, and display your data solely for the purpose of providing the Application's services to you. This license terminates when you delete your data or your account.
6.3 Anonymized Usage Data
We may collect anonymized, aggregated usage data (such as feature engagement frequencies, crash rates, and performance metrics) to improve the Application, fix bugs, and develop new features. This data does not identify you personally and is processed in compliance with our Privacy Policy.
6.4 Backups and Data Loss
While we take reasonable measures to protect your data, we are not liable for data loss due to circumstances beyond our reasonable control, including but not limited to: third-party service outages, hardware failures, network disruptions, or force majeure events. We recommend you maintain your own backups of critical data.
7. Intellectual Property
7.1 Our Rights
The Application, including its software, design, branding, logos, and content (excluding your data), is the exclusive property of Petros Chatzianastasiou. All rights reserved. No license to our intellectual property is granted to you except as expressly stated in these Terms.
7.2 Trademarks
"DialDay" and any associated logos are trademarks of Petros Chatzianastasiou. You may not use these trademarks without prior written permission.
7.3 Feedback
If you provide us with feedback, suggestions, or ideas about the Application ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that Feedback for any purpose, including incorporating it into the Application, without obligation to you.
8. Third-Party Services
The Application uses third-party services to provide its functionality, including:
- Supabase, Inc. — backend database and authentication (EU region)
- RevenueCat, Inc. — subscription management
- Apple App Store / Google Play — payment processing
- Sentry, Inc. — error monitoring and crash reporting (EU region)
Your use of the Application is also subject to the terms and policies of these third-party services. We are not responsible for the practices of third parties.
9. Disclaimers and Limitation of Liability
9.1 "AS IS" Service
The Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to: warranties of merchantability, fitness for a particular purpose, non-infringement, or error-free operation. We do not warrant that the Application will meet your specific requirements or be uninterrupted, secure, or error-free.
9.2 No Business Outcome Warranties
The Application is a tool to help you organize your sales activity. We make no warranties about your sales results, income, conversion rates, or business outcomes. Your success depends on your own efforts, skills, market conditions, and other factors beyond our control.
9.3 Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: lost profits, lost revenue, lost data, loss of goodwill, or business interruption, arising out of or related to your use of the Application.
Our total aggregate liability arising from or related to these Terms or the Application shall not exceed the greater of:
- The amount you paid us in subscription fees in the 12 months preceding the event giving rise to the claim, or
- €100 (one hundred euros)
These limitations apply even if we have been advised of the possibility of such damages.
9.4 Statutory Rights
Nothing in these Terms excludes or limits our liability for: death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law. EU consumers retain all statutory rights under EU consumer protection law.
10. Indemnification
You agree to indemnify, defend, and hold harmless the Service Provider from any claims, damages, liabilities, losses, or expenses (including reasonable legal fees) arising out of:
- Your use of the Application
- Your violation of these Terms
- Your violation of any third-party rights, including data protection or intellectual property rights
- Your CRM data or content
- Your communications with contacts
11. Modifications to the Service
We reserve the right to modify, suspend, or discontinue the Application (in whole or in part) at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation, except where prohibited by law.
For paid subscribers, in the event of a material reduction in service, we will provide reasonable notice and offer a prorated refund through Apple App Store or Google Play where required by law.
12. Modifications to These Terms
We may update these Terms from time to time. When we make material changes:
- We will update the "Last Updated" date at the top
- We will notify you through the Application or via email (for material changes)
- Continued use of the Application after changes constitutes acceptance of the updated Terms
If you do not agree to the updated Terms, you must stop using the Application and may delete your account.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of Greece (Hellenic Republic), without regard to conflict of law principles.
13.2 Jurisdiction
Any disputes arising out of or related to these Terms or the Application shall be subject to the exclusive jurisdiction of the courts of Athens, Greece, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
13.3 EU Consumer Rights
If you are a consumer residing in the European Union, you may also bring proceedings in the courts of your country of residence under applicable EU consumer protection regulations. You also have access to the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
13.4 Informal Resolution
Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute by contacting us at support@dialday.app. We will respond within 30 days and work in good faith to resolve the matter.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Service Provider regarding the Application, superseding any prior agreements.
16. No Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision. Any waiver must be in writing to be effective.
17. Assignment
You may not assign or transfer these Terms (or any rights or obligations under them) without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
18. Force Majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, pandemics, government actions, internet outages, or third-party service failures.

These Terms are provided in English. In case of conflict between this version and any translated version, the English version prevails.
